Tokenized US stocks in Australia

Crypto rules in Australia
Buying, selling and holding crypto is legal in Australia, but it isn't legal tender. New laws for digital-asset platforms start on 8 April 2027, according to ASIC.
Money and tax in Australia
Local currency: Australian dollar (AUD).
Paying and sending money abroad: Australian brokers offer shares on the NYSE and Nasdaq. You usually fill in a W-8BEN form so the right US tax is withheld on dividends.
Tax: Selling or swapping crypto is usually a capital gains tax event. Australian residents who hold for at least 12 months can currently get a 50% CGT discount; the ATO says legislated changes apply to gains from 1 July 2027.
What you're actually buying
A token that tracks a real US share 1:1. The issuer holds the actual shares; you hold the token. Price moves and reinvested dividends, yes. Voting rights and a seat at the shareholder meeting, no.

Questions people ask
Is swapping one crypto for another taxable in Australia?
It can be. The ATO treats a swap as a CGT event even if you never receive Australian dollars.
Is my gain tax-free if I hold for a year?
No. Under current rules an eligible resident can cut the gain by 50%, not wipe it out.
Are tokenized US stocks legal in Australia?
Honestly, it depends on the product and on Australia's own rules for securities, crypto and moving money abroad. We haven't finished checking Australia yet, so we're not making a legal call. The regulator linked on this page is the best place to check.
Do I own the actual shares?
Usually not directly. With xStocks, the issuer holds the real shares and you hold a token that tracks them. Other products work differently — some are just contracts tracking the price. Voting rights and cash dividends are normally not included.
Can I use a VPN if an app blocks Australia?
Please don't. Getting around location blocks, sanctions or ID checks breaks the app's rules, can get your money frozen, and may be illegal.
